The only reason he is being charged with a hate crime is because he blatantly admitted to the reason why he attacked the other person.
Very, very, very rarely do you see a suspect incriminate themselves and volunteer that much information to investigators.
In the other 99% of crimes like this that occur, the police can only go off of witness testimony ("I heard someone in the mob say 'Justice for Trayvon!'"), which police arbitrarily dismiss - but seemingly only against one demographic.
That's the problem with thought crimes. But you already know all this, so I don't know why you're trying to play the 'gotcha' game when you already know the answer.
